General Terms & Conditions

General Conditions of the FlyPryde Paris, manufacture and sale of leather goods, head office is located at, 10 rue de la Paix,75002, Paris.

The general conditions of sales described hereafter detail the rights and obligations of FlyPryde Paris and its customer within the framework of the sale of the following goods:
- Vegan leather goods
- Belts
- Accessories

ARTICLE 1 : Acceptance and scope of application of any order of goods implies the acceptance without reserve by the purchaser and his full and complete adhesion to the present general conditions of sale which prevail over any other document of the purchaser, except negotiation of conditions between the parties.

ARTICLE 2 : Order taking
2.1: Order validation
Orders are only final when they have been paid. The confirmation of order will specify the references of the ordered goods, their nature, their quantity, delivery time and terms of payment.
2.2 : Modification of the order
The terms of the orders transmitted to FlyPryde Paris are irrevocable for the customer, except written acceptance of our share. In this assumption, FlyPryde Paris will not be held with the respect of the initially agreed times.

ARTICLE 3 : Delivery
3.1 : Delivery times.
The delivery times are given only as an indication, these depending in particular on the availability of the goods and the order of arrival of the orders. Delays in delivery cannot give rise to any penalty or compensation, nor can they motivate the cancellation of the order. However, if 1 month after the indicative date of delivery, the goods have not been delivered, for any other reason than a case of force majeure, the sale may then be cancelled by right at the request of either party, by registered mail with acknowledgment of receipt. The customer will then be able to obtain restitution of his payment with the exclusion of any other allowance or damages.in any assumption, the delivery within the deadlines can intervene only if the customer is up to date of his obligations towards FlyPryde Paris, whatever is the cause, and without the customer being able to claim with an unspecified allowance.
3.2 : Modalities of delivery
The delivery is carried out, either by the direct handing-over of the product to the customer, or by simple opinion of provision, or by delivery to a shipper or a conveyor by FlyPryde Paris. Within the framework of a direct handing-over, the delivery will be the subject of the emission of a delivery order having to be the subject of the signature of the two parts.
3.3 : Risks the transfer of the risks on the goods sold by FlyPryde Paris is carried out with the handing-over of the goods to the conveyor or with the exit of our buildings.it results from it that the goods travel with the risks and dangers of the purchaser, to which it belongs, in the event of damage, of loss or missing, to make any reserve or to exert any recourse near the carriers responsible, in accordance with the article L.133-3 of the Code of trade (Note: not applicable to the international transport).
3.4 : Complaints upon receipt. Claims concerning the non-conformity of the goods delivered with the goods ordered must be made by registered letter with acknowledgement of receipt or by letter delivered by hand against a receipt, regardless of the seller's default.

ARTICLE 4 : Return of goods
Any return of goods must be the subject of a written agreement between FlyPryde Paris and the customer. Any returned goods without this agreement will be held at the disposal of the customer and will not give place to the establishment of a credit note or the refunding of the aforementioned sum. The expenses and the risks of the return are always the responsibility of the customer. Any accepted resumption will involve, after checking of the returned products with the choice of our FlyPryde Paris, the refunding of the aforementioned sum.

ARTICLE 5 : Prices
Our goods are supplied at the price in force at the time of the placing of the order. The prices are inclusive of all taxes. Any tax, duty or other service to be paid in application of the French legislation or that of the importing country or of a country of transit and any modification of these between the date of order and that of the invoice are at the expense of the purchaser. Shipping costs are at the buyer's expense.

 

ARTICLE 6 : Invoicing any purchase of goods and services will be the subject of an invoice which will be delivered as of the realization of the sale, in accordance with the provisions of the article L.441-3 of the Commercial code. The invoice issued will include all the products supplied.

 

ARTICLE 7 : Payment
7.1 : Modalities The payments will be carried out with the order
The payments will be carried out under the following conditions:
- Payment by Paypal to FlyPryde Paris
- By bank or postal transfer stipulating the N° of invoice- Par purchase via bank card on the site FlyPryde Paris

- By Google Pay

 

ARTICLE 8 : Reserve of property
FlyPryde Paris reserves the property of the sold goods until the integral payment of their price in principal and interests in accordance with the law N° 80.355 of May 12, 1980. In the absence of payment of the price at the agreed term, FlyPryde Paris will be able to take again the goods, the sale will be solved automatically if good seems to FlyPryde Paris and the installments already versed will remain to us in counterpart of the enjoyment of the goods from which the customer will have benefited. Transfer of risks: The goods will remain the property of our mark FlyPryde Paris until the integral payment of their price, but the customer will become responsible for them as of their material handing-over, the transfer of possession involving that of the risks. The customer commits himself, consequently to subscribe, as of now a contract of insurance guaranteeing the risks of loss, flight or destruction of the designated goods.

 

ARTICLE 9 : Force majeure
The occurrence of a case of force majeure has for effect to suspend the execution of the contractual obligations of FlyPryde Paris. Is a case of absolute necessity, any event independent of the will of our company and making obstacle with its normal operation at the stage of the manufacture or the forwarding of the goods. Constitute in particular cases of absolute necessity, the total or partial strikes impeding the good functioning of our company or that of one of our suppliers, subcontractors or carriers as well as the interruption of transport, of the supply of energy, raw materials or spare parts.

 

ARTICLE 10 : Attribution of jurisdiction
For all the contestations relative to the sales carried out by FlyPryde Paris as well as those relative to the interpretation of the general conditions of sale, only will be qualified the Commercial court of Paris.

ARTICLE 11 : Applicable law
Any question relating to the present general conditions of sale which would not be treated by the present contractual stipulations will be governed exclusively by French law.
